These Terms of Service ("Terms") govern your use of TalkIELTS("we", "us", "our"), a website that provides AI-powered IELTS Speaking practice, mock tests, and feedback, accessible at https://talkielts.com (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

TalkIELTS is an independent practice tool and is not affiliated with, endorsed by, or connected to Cambridge Assessment English, the British Council, or IDP Education Australia. IELTS® is a registered trademark of its respective owners.

You may need to create an account to use certain features. You agree to provide accurate information, keep your password confidential, and be at least 13 years old (or the minimum digital-consent age in your country). You are responsible for activity that occurs under your account.

The Service offers a free plan (limited number of mock tests per month) and paid subscription plans with expanded usage. Plan features and prices are shown on our Pricing page and may change with notice.

All payments are processed by Paddle.com Market Ltd ("Paddle") as our Merchant of Record. Paddle is the entity that sells you the subscription and handles all payment, invoicing, tax collection, and refund processing. Your payment details are provided to and stored by Paddle, not by us.

When you purchase a plan, you authorize Paddle to charge the payment method on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing cycle (monthly or yearly, depending on your plan).

You may cancel your subscription at any time from your account settings or by contacting Paddle support. Cancellation stops future renewals; access continues until the end of the paid period. For refund requests, please contact Paddle support at paddle.net or us at [email protected]. New subscribers are covered by a 7-day money-back guarantee: if you are not satisfied, you may request a full refund within 7 days of your first charge, no questions asked. After that, refunds for unused partial periods may be granted at our discretion within 14 days of a charge.

You agree not to:

• Use the Service for any unlawful purpose or to harm others;
• Share account credentials or resell access to the Service;
• Scrape, reverse-engineer, or attempt to extract content, models, or data at scale;
• Upload content that is abusive, hateful, or infringes others' rights;
• Interfere with the operation or security of the Service.

Band scores and feedback are generated by artificial intelligence and are provided for practice purposes only. They are estimates and do not constitute an official IELTS score or a guarantee of results on any official test.

The Service, including its software, practice questions, design, and brand, is owned by us or our licensors and protected by intellectual property laws. You retain ownership of the audio you record and answers you write; you grant us a limited license to process them for operating and improving the Service, as described in our Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.

To the maximum extent permitted by law, we and Paddle shall not be liable for indirect, incidental, special, or consequential damages, or for lost profits or data. Our total liability arising out of the Service shall not exceed the amount you paid to Paddle in the 12 months before the claim.

You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk or legal exposure for us, with or without notice.

We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
